Terms of Use for nePlay

Welcome to nePlay. These Terms of Use (“Terms”) govern your access to and use of the nePlay mobile application, website, and related services (collectively, the “Services”).

These Terms are entered into between you and nePlay.

By accessing or using nePlay, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Services.

1. Acceptance of Terms

By creating an account or using nePlay, you confirm that:

  • You have read and understood these Terms
  • You agree to comply with these Terms
  • You agree to our Privacy Policy and Child Safety & Abuse Prevention Policy

2. Eligibility

You must be at least 13 years old (or the minimum legal age required in your country) to use nePlay.

By using the Services, you represent and warrant that you meet all eligibility requirements.

3. Account Registration and Security

  • You are responsible for maintaining the confidentiality of your login credentials
  • You are responsible for all activity that occurs under your account
  • You must provide accurate and up-to-date information
  • nePlay reserves the right to suspend or terminate accounts that violate these Terms

4. User Content

4.1 Ownership

You retain ownership of the content you create and upload to nePlay.

4.2 License to nePlay

By uploading or posting content, you grant nePlay a non-exclusive, worldwide, royalty-free license to host, store, reproduce, distribute, display, and promote your content within the Services.

4.3 Content Restrictions

You must not upload or share content that:

  • Is illegal, harmful, misleading, or abusive
  • Involves child sexual abuse or exploitation
  • Violates intellectual property rights
  • Contains hate speech, harassment, or threats
  • Is sexually explicit or exploitative
  • Promotes violence, fraud, or illegal activities

5. Prohibited Conduct

You agree not to:

  • Use nePlay for unlawful purposes
  • Attempt unauthorized access to systems or accounts
  • Interfere with platform security or functionality
  • Engage in scams, impersonation, or fraud
  • Harass, threaten, or abuse other users

6. Live Streaming, Coins, and Virtual Gifts

  • Live streaming features are subject to additional moderation rules
  • Virtual coins and gifts have no real-world monetary value
  • Coins, gifts, and virtual items are non-refundable unless required by law
  • nePlay may modify or discontinue virtual items at any time

7. Payments and Subscriptions

  • Purchases made through Apple's App Store are subject to Apple's payment and refund policies
  • Payments are processed by third-party payment providers
  • nePlay does not store full credit or debit card details
  • nePlay is not responsible for payment errors caused by third-party providers

8. Intellectual Property

All nePlay trademarks, logos, software, and platform designs are owned by nePlay or its licensors.

You may not copy, modify, distribute, or exploit any part of the Services without written permission.

9. Moderation and Enforcement

nePlay reserves the right to:

  • Remove or restrict content
  • Suspend or terminate accounts
  • Limit access to features
  • Report violations to authorities where required

nePlay is not obligated to monitor all content but may do so at its discretion.

10. Account Termination

  • You may stop using nePlay at any time
  • nePlay may suspend or terminate your account for violations of these Terms
  • Upon termination, access to your account and content may be restricted or removed

11. Data Deletion

Users may request deletion of their account directly within the app by navigating to:
Settings → Delete Account

Once a deletion request is confirmed:

  • The account will be scheduled for permanent deletion
  • The user will be logged out of the app
  • The deletion process cannot be undone

Deleted account data is soft-deleted immediately and permanently erased within 30 days, unless retention is required for legal, security, fraud prevention, or regulatory obligations.

12. Disclaimers

The Services are provided “as is” and “as available.”

nePlay does not guarantee uninterrupted, error-free, or secure operation of the Services.

13. Limitation of Liability

To the maximum extent permitted by law, nePlay shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of data, revenue, or profits
  • User-generated content or third-party actions

14. Indemnification

You agree to indemnify and hold harmless nePlay, its directors, employees, and partners from any claims, damages, or expenses arising from:

  • Your use of the Services
  • Your content
  • Your violation of these Terms

15. Governing Law

These Terms are governed by and interpreted in accordance with the laws applicable in the jurisdiction where nePlay operates, without regard to conflict of law principles.

16. Changes to These Terms

nePlay may update these Terms from time to time.

Continued use of the Services after changes are made constitutes acceptance of the updated Terms.
